Access to and use of our website www.tigersanddragons.com as well as purchasing products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices. By using the Services, you are agreeing to all of the Terms of Service. The terms that apply to you are those posted here on our Website on the day you order Goods. We advise you to print a copy for your records and to check this page regularly to take notice of any changes we may have made to our Terms and Conditions.

Governing Law
We must receive the full payment for the price of the goods that you order before your order can be accepted and processed. Once payment has been received by us we will confirm your order by sending an email to you at the email address you provide in your order form. Our acceptance of your order takes place on the despatch to you of the products ordered unless we notify you that we do not accept your order, or you have cancelled your order. If we do not have all of the Goods you order in stock, you may accept the alternatives we offer or cancel part or all of your order.
Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.
2.1 The prices payable for goods that you order are as set out in our website.
2.1.1 All our goods are priced in US dollars and marked at their actual value. You will be billed in US dollars. The total amount you will pay for your order may vary due to currency fluctuations and credit card charges.
2.2 The price of our items does not include the delivery charge which will be charged at the rates set out in our website.

2.4 We advise you to make note of your country's customs policy, as you are responsible for the payment of import duties and taxes of any kind levied in your country.
Payment will be processed by Paypal ™ and can be made by Mastercard, Visa, American Express, through your Paypal ™ account and any other methods accepted by Paypal™.
4.1. We will insure each purchase during the time it is in transit until it is delivered.
4.2 We will deliver the products ordered by you to the address stipulated in your order. It is your responsibility to ensure that the delivery address, contact number and e-mail you give us are correct and accurate and that an adult aged 18 years or over is present to sign and accept delivery of the goods.
4.3 You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
4.4 If your order is returned to us because the postal or express courier service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.

5.1 You may cancel your order at any time before we despatch your order or before the expiry of 7 working days from the date you receive your order, not including the day you received it. If you do, we will refund to you the price of the Goods. We will not refund shipping charges on return items.
5.2 Your right to cancel your order with us for the goods you have ordered is subject to you submitting a Product Return Form to us within 7 days of receiving your goods.

5.4 Once you have notified us that you are cancelling your order, any sum debited from your credit card will be credited to your account within 14 days of receipt by us of the returned Goods provided that you return the goods to us in the same condition in which you received them. We will not refund your money if the Goods have been used, worn or damaged. If you do not return the goods delivered to you, in the way detailed above, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.
5.5 We reserve the right to cancel your order if:
5.5.1 we have insufficient stock to deliver the goods you have ordered;
5.5.2 we do not deliver to your area; or
5.5.3 one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
5.6 If we do cancel your contract we will notify you by email or by telephone, and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
6.1 We will repair, replace or refund damaged or defective goods providing you notify us by e-mail within 7 working days of the delivery of the goods in question. If you claim that the item is defective, the following conditions apply:
6.1.1 the defects result only from faulty design or manufacture
6.1.2 You have returned the defective goods or parts
7.1 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 7.2.3 above.
7.2 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
7.3 No term in this agreement shall take effect to reduce or remove any right you have under any law on account of your status as a consumer.
7.4 We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or carrier.
7.5 We will not be liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Tigers and Dragons Gift certificates or vouchers are sold subject to the following terms and conditions:
- Gift Cards are valid for 12 months from date of purchase.
- Gift Cards can be redeemed against all products on the the www.tigersanddragons.com site.
- Gift Cards are non transferable and may not be returned or redeemed for cash.
- If your order total is less than the value of the Gift Card, you may redeem the remaining balance against subsequent orders.
- If your order exceeds the value of the Gift Card all remaining balances exceeding the value of your gift credit or store credit must be paid by credit card or any other method accepted by Paypal ™.
- If you return products you have purchased using a Gift Card, the remaining balance will be credited to your account and will be redeemed against subsequent orders.
- Virtual Gift Cards will be e-mailed to the recipient once the full order has been processed and payment has been taken. A copy will also be sent to the sender as confirmation of dispatch.
- Media Sphere Co., Ltd is not liable for delivery of a Virtual Gift Card to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.
- Media Sphere Co., Ltd is not responsible if a Gift Card is lost, stolen, destroyed or used without permission.
- Media Sphere Co., Ltd reserves the right to cancel a Gift Card if we deem such action necessary.
- Sales tax and shipping is applicable on any products purchased with a Tigers and Dragons Card.
You acknowledge and agree to be bound by the terms of our Privacy Policy.
10.1 We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).
10.2 You may not copy, modify, publish, sell, reproduce, create derivative works from, distribute, display, or in any way exploit any of the Content of our site without written permission from us.
10.3 You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person without written permission from us
The Terms and Conditions together with all our policies and procedures will be governed by and construed in accordance to the relevant Thai law and the relevant courts of Thailand will have exclusive jurisdiction.
